Dr John Pardey
The Supreme Court found in July that the health service breached her employment contract by continuing to suspend her despite its independent investigation dismissing the serious allegations.
The complaints were made by an obstetrician, John Pardey, a neonatologist, Heather Coughtrey and the acting director of the unit, Mark Tracy.
Justice Rothman said Dr Pardey "was prepared to reconstruct where there was no memory and embellish answers". Dr Tracy's evidence was "obfuscatory and his recollection convenient". He did not accept Dr Coughtrey's evidence.
A spokeswoman for the Sydney West Area Health Service said it "has accepted the Supreme Court findings in favour of Dr Lynette Downe" and accepts that Dr Downe is an "exceptional" clinician.
